PPP/NPD
The landscape for infrastructure investment in Scotland is evolving, most recently to reflect the emerging policy objectives of the Scottish Government. The Scottish Government is establishing the Scottish Futures Trust (SFT) to help procure and fund new infrastructure in Scotland, and has adopted the Non Profit Distributing (NPD) model as the means to secure private funding of infrastructure projects.
Brodies' Projects team is leading these developments, having advised on the largest Scottish PPP procurement using the NPD model to date and having adapted the Scottish Government's Health PPP Contract for use in NPD procurements. We have advised on NPD projects in the healthcare and education sectors, and on PPP projects in the waste and water sectors.
As well as advising both public and private sector clients on PPP procurements in a range of sectors, the team also advises on secondary market acquisitions.
