Mediation and Alternative Dispute Resolution

It can't always be avoided, but Tribunal litigation is not the only means of resolving workplace disputes. Mediation, and other forms of alternative dispute resolution, can often provide a speedier and more cost effective way of resolving employment disputes than the employment tribunal. The outcome of a mediation is in the hands of the parties and it is a flexible process. Unlike the tribunal process, you keep control and can agree outcomes which the employment tribunal can't award.

Mediation is becoming an increasingly popular means of resolving disputes in the context of ongoing employment relationships; it can ensure that effective working relationships are maintained, in circumstances where negotiations have become deadlocked or where particular sensitivities make a public hearing undesirable.
