Regulation & Compliance

Industry & Professional Regulators

Your business may be regulated by industry regulators, like the Scottish Environment Protection Agency or the Health and Safety Executive. Alternatively, you may be regulated by a professional body, or you may be a regulator yourself. We will guide you through any regulatory questions which may arise.

The Regulatory Compliance and Enforcement team ("RCE") provides service to clients who are regulators and clients operating in regulated sectors. We advise and support clients at all stages of the regulatory process with a focus on:

  • Compliance - advising regulated clients working to maintain compliance in the sector in which they operate, and advising regulators on how best to achieve compliance in their sector; and
  • Enforcement - where compliance is not achieved, enforcement may follow. We aim to find practical solutions, but where court action in unavoidable we have the experience to obtain the best possible result for our clients.

We provide services across a broad spectrum of regulated sectors including:

  • Professional discipline
  • Environment & Waste Management
  • Health and Medical Research
  • Broadcasting & Advertising
  • Health & safety
  • Construction
  • Utilities

Health & Safety

We'll advise you on Health and Safety issues within your business and can help you to identify and cost the risks you and your organisation face in dealing with the regulatory framework. We also regularly defend clients in health and safety prosecutions.

Policy Advice & Training

We've been advising public sector bodies for many years and have advised many private sector clients on their dealings with public authorities. We will give you legal advice on your policies and procedures and help you avoid legal challenge. We can also provide legal risk assessments on any aspect of your business and help you make any necessary changes.
