Debt Recovery

Brodies specialises in recovery of both commercial and consumer debts on behalf of a wide range of clients.

State-of-the-art case management software allows undefended proceedings to be progressed quickly and efficiently from the stage of demand letters through to court action and enforcement. Instructions can be given electronically and reporting tailored to individual clients' needs is available whenever required.

We can take protective measures (known as diligence on the dependence or 'interim diligence') at the outset of proceedings if you fear your debtor is about to become insolvent.

Fees are generally fixed for each step, enabling you to keep track of costs. With commercial debt we will seek to recover statutory compensation and interest for late payment on your behalf.

We have particular expertise in the use of insolvency procedures to recover sums owing - statutory demands against individuals and companies, abbreviated demands and bankruptcy and liquidation petitions. We are able to instruct recovery through agents in foreign jurisdictions.

Our services include:

  • Seven-day demand letters
  • Statutory demands against individuals and companies
  • Abbreviated demands against companies
  • Court actions for payment, UK wide
  • Handling contested litigation
  • Bankruptcy and liquidation petitions
  • Instructing recovery in foreign jurisdictions
  • Drafting and revising terms and conditions of contract
  • Advising in relation to retention of title issues
  • Bulk instructions
  • Reposession

For your convenience in providing our Debt Recovery Team with instructions, attached is an instruction form which can be e-mailed, faxed or posted to us, hopefully making your job that little bit easier.

Professional Account Recovery (PAR)

In 2010, and based on experiences gained with professional clients, Brodies identified a need for a service specifically tailored to the needs of professional firms - e.g. architects, surveyors, accountants and even other lawyers. Hence Professional Account Recovery or "PAR" came in to being. Please click on the links below for further details:
